Terms of Service

Effective date: October 20, 2026

1. The Service

DMisland ("the Service") lets owners of Instagram professional accounts automatically reply to comments on their own posts with direct messages. By creating an account you agree to these terms.

2. Your account

  • You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
  • You may only connect Instagram accounts that you own or are authorized to manage.
  • One active Instagram connection is allowed per account, unless your plan permits more.

3. Acceptable use

You agree not to use the Service to:

  • send spam, unsolicited promotions, or messages that violate Meta's Platform Terms and Community Guidelines;
  • send deceptive, harassing, or illegal content, or content that infringes the rights of others;
  • circumvent rate limits or other technical restrictions of the Service or of the Instagram platform.

All messages are sent only in response to a user's comment, reply, or button tap. The Service enforces Instagram's messaging policies and may pause delivery to keep your account compliant.

4. Instagram platform

The Service has completed Meta Business Verification and App Review, and uses the official Instagram API provided by Meta. Instagram is a trademark of Meta Platforms, Inc. Your use of Instagram remains subject to Meta's own terms, and changes to the Instagram API may affect Service functionality.

5. Subscriptions, billing, and refunds

Paid plans are billed through our payment provider, either monthly or annually in advance. Subscriptions renew automatically until cancelled. You can cancel anytime in Settings; after cancellation your plan remains active until the end of the period you already paid for - we do not prorate or refund the unused portion. Usage limits for each plan are described on the pricing page.

First-payment refund

If, within 48 hours of your first payment, the direct messages you have sent stay within the Free plan's limit (1,000 per month), you can cancel from Settings and receive a full refund. Outside that window, or once you've sent more direct messages than the Free plan allows, payments are non-refundable - this reflects that you've already received the paid plan's benefit.

Service interruptions

  • If you can't use the Service because of an issue on your side (for example, your Instagram account is suspended or restricted by Meta), no refund is due.
  • If the Service itself is blocked or restricted by Meta for all users, we provide a service credit (extended subscription time or additional usage) rather than a cash refund.
  • If an issue caused by us is not resolved within 14 days, we will refund the unused portion of your current period.

Refunds, where due, are issued by our payment provider (a merchant of record) to your original payment method.

6. Limitation of liability

  1. We are not liable for failing to provide the Service due to causes beyond our control, such as natural disasters, power or network outages, or outages, policy changes, or API restrictions by Meta (Instagram).
  2. We are not liable for disruptions caused on your side - for example, incorrect settings, changing your Instagram account type or removing permissions, enforcement actions by Meta on your account, or violations of these terms.
  3. The Service is provided "as is." We do not guarantee that any particular message will be sent or any specific results, such as sales or follower growth.
  4. Except for liability arising from our intentional misconduct or gross negligence, our total liability for any claim related to the Service is limited to the fees you paid us in the three months before the damage occurred.

7. Termination

You may delete your account at any time in Settings. We may suspend or terminate accounts that violate these terms or put the platform integration at risk, with notice where reasonably possible.

8. Changes

We may update these terms as the Service evolves. Material changes will be announced on this page with a new effective date. Continued use after changes take effect constitutes acceptance.
